These Terms & Conditions (“Terms”) govern your access to and use of the website https://www.sannidhi.yoga, the Sannidhi student dashboard, and the online courses, programmes and services offered by Sannidhi: Sacred Seeds of Yoga (“Sannidhi”, “we”, “us”, “our”). By accessing our website, creating an account, or enrolling in any course, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Definitions
- “Platform” means our website and the student dashboard through which courses are delivered.
- “Content” means all videos, audio, text, images, course materials, designs, logos and marks made available through the Platform.
- “Course” means any online course, programme, class, workshop or session we offer.
- “Services” means the Platform, the Courses and all related services.
- “You” / “User” means any person who accesses the Platform or enrols in a Course.
2. Eligibility
You must be at least 18 years old to create an account and purchase a Course. A parent or legal guardian may enrol and provide consent on behalf of a minor and is responsible for the minor’s use of the Services. By using the Services, you confirm that the information you provide is accurate and that you have the legal capacity to enter into these Terms.
3. Accounts & Security
To access certain Services you must register for an account, which may be hosted through our third-party student-dashboard provider. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use. We may suspend or terminate accounts that breach these Terms.
4. Courses, Enrolment & Access
Upon successful payment, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access the relevant Content for your own personal, non-commercial learning, for the access period stated for that Course. Access may be provided through a third-party learning platform. Course schedules, syllabi, faculty and content may be updated or improved from time to time. You may not share your account, login or Course access with any other person.
5. Fees, Payment & Taxes
Fees are displayed at checkout in the stated currency and are payable through third-party payment gateways. Applicable taxes (such as GST) may be added where required by law. By placing an order, you authorise us and our payment processor to charge the displayed amount. We may change our fees from time to time, but changes will not affect Courses you have already purchased.
6. Intellectual Property
All Content, and the name “Sannidhi” together with our logos and related marks, is owned by or licensed to Sannidhi and is protected by intellectual-property laws. Except for the limited access licence in Section 4, you may not copy, record, download (except where expressly permitted), reproduce, republish, distribute, sell, sub-licence, broadcast or create derivative works from the Content without our prior written consent. Recording or screen-capturing live sessions is prohibited unless expressly authorised by us.
7. Acceptable Use
You agree not to:
- misuse the Platform or attempt to gain unauthorised access to any part of it;
- upload or transmit any malware, or interfere with the operation of the Services;
- infringe the intellectual-property or other rights of Sannidhi or any third party;
- harass, abuse or harm our faculty, staff or other students;
- use the Services for any unlawful or fraudulent purpose;
- scrape, copy or systematically extract Content; or
- circumvent access controls or share paid Content with others.
8. User Submissions
If you submit testimonials, reviews, questions or other materials to us, you grant Sannidhi a non-exclusive, royalty-free, worldwide licence to use, reproduce and display such submissions for the purpose of operating and promoting our Services. You are responsible for the content you submit, and you confirm you have the right to share it. We may moderate, edit or remove submissions at our discretion.
9. Health, Medical & Safety Disclaimer
Yoga involves physical movement and breathing practices. Our Courses are provided for general educational and wellbeing purposes only and are not medical advice, diagnosis or treatment, and are not a substitute for professional medical care.
- Consult a qualified physician before beginning any yoga, breathing (pranayama), meditation or exercise programme, especially if you are pregnant, recovering from injury or surgery, or have any cardiac, respiratory, musculoskeletal, psychological or other medical condition.
- You participate voluntarily and at your own risk. Listen to your body, never force a posture, and stop and seek medical help if you experience pain, dizziness or discomfort.
- To the maximum extent permitted by law, Sannidhi, its faculty and staff are not liable for any injury, loss or harm arising from your practice or participation. By enrolling, you acknowledge and assume these risks.
10. Third-Party Platforms & Links
Our Services rely on third-party platforms (including the student dashboard, payment gateways, video hosting and communication tools) and may link to third-party websites. We do not control and are not responsible for their content, availability or practices. Your use of them is at your own risk and subject to their own terms.
11. Disclaimers
The Services and Content are provided on an “as is” and “as available” basis. We do not warrant that access will be uninterrupted or error-free, that any particular result will be achieved, or that the Content is complete or current. Educational outcomes depend on individual effort and circumstances.
12. Limitation of Liability
To the maximum extent permitted by law, Sannidhi’s total aggregate liability arising out of or relating to the Services or these Terms shall not exceed the amount you paid to us for the specific Course giving rise to the claim in the twelve (12) months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Sannidhi, its faculty, staff and affiliates from and against any claims, damages, losses and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
14. Suspension & Termination
We may suspend or terminate your access to the Services for breach of these Terms, non-payment, or unlawful conduct, with or without notice. Upon termination, your licence to access Content ends. Provisions that by their nature should survive termination (including those on intellectual property, disclaimers, limitation of liability, indemnification and governing law) will continue to apply.
15. Changes to Services & Terms
We may modify the Services or these Terms from time to time. Revised Terms will be posted on this page with a new “Last updated” date and, where appropriate, we will notify you of material changes. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law, Jurisdiction & Disputes
These Terms are governed by the laws of India. The courts at Kolkata, India shall have jurisdiction, and any dispute shall be handled in accordance with our separate Governing Law & Jurisdiction Policy (also referred to as the “Law of Judiciary”), which forms part of these Terms.
17. Miscellaneous
- These Terms, together with our policies, constitute the entire agreement between you and Sannidhi regarding the Services.
- If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
- Our failure to enforce any right or provision is not a waiver of that right or provision.
- We may assign these Terms; you may not assign them without our prior written consent.
- We are not liable for any failure or delay caused by events beyond our reasonable control (force majeure).
- Notices to us should be sent to enquiry@sannidhi.yoga. Nothing in these Terms creates any agency, partnership or employment relationship between you and Sannidhi.
